    The U.S. Department of Justice is gearing up for a legal battle against the state of Texas over a controversial new law aimed at curbing illegal entry. Governor Greg Abbott signed SB 4 into law on December 18, asserting its necessity to counter the “tidal wave of illegal entry into Texas.” The legislation establishes a state criminal offense for unauthorized entry into Texas from a foreign country, with repeat offenders facing potential prison sentences of up to 20 years.

    Scheduled to take effect on March 5, the law faces immediate challenges, with two lawsuits likely to impede its implementation. Within a day of Governor Abbott signing SB 4, El Paso County and various advocacy groups filed lawsuits, contending that the law establishes Texas’ independent immigration entry and re-entry crimes, circumventing federal authority in immigration matters. They argue that state police arrest noncitizens, state prosecutors bring charges in state courts, state judges order deportation, and state officers execute those orders, entirely excluding the federal government from the process.     2 days ago, NY Mayor Eric Adams signed an executive order to curb the flow of migrant buses from Texas. For the second night in a row, buses from Texas are defying his order.

    An attorney representing the plaintiffs emphasized that Governor Abbott’s attempt to bypass the federal immigration system and deny due process is not only unconstitutional but also poses a risk of errors, disproportionately impacting Black and Brown individuals irrespective of their immigration status.

    The U.S. Department of Justice echoes these concerns. In a letter to Governor Abbott, Principal Deputy Assistant Attorney General Brian Boynton labeled SB 4 as unconstitutional and warned of disruptions to federal government operations. The letter, published by CBS News, serves as notice of the Justice Department’s intention to file a lawsuit, seeking to uphold the supremacy of federal law and block the enforcement of SB 4.

It emphasizes that the Constitution tasks the federal government with regulating immigration and controlling international borders.

    Governor Abbott responded to the Justice Department’s letter on social media, accusing the Biden Administration of refusing to enforce existing U.S. immigration laws and attempting to impede Texas from enforcing its own laws against illegal immigration. He declared his commitment to challenging all legal obstacles related to Texas border bills in the U.S. Supreme Court, portraying the situation as a necessary act of self-defense in the absence of federal action.

    Deeper legal conflicts loom, with Boynton asserting that the Texas law clashes with the U.S. Constitution and federal statutes. Abbott, in defense of the state’s actions, referenced Article 1 Section 10 of the Constitution, asserting Texas’ authority to defend itself in light of perceived federal inaction.

    The legal wrangling comes amid a broader context of escalating border issues. Texas has allocated over $11.5 billion in taxpayer funds for state border security efforts, responding to an influx of more than 1.9 million foreign nationals illegally entering the state from January 1, 2021, to September 30, 2023. Thousands continue to cross daily, prompting over 50 Texas counties to declare an invasion and more than 60 to issue disaster declarations, citing the ongoing border crisis.
