    Confusion and Resistance: Illinois Gun Owners Grapple with New Assault Weapons Registration Law

    Gun owners in Illinois are facing confusion and frustration as the state pushes for the registration of “assault” weapons under its new ban. The deadline for Illinoisans to register their assault weapons was January 1, as the state’s Democratic Governor, J.B. Pritzker, signed the ban into effect on January 10.  A very small percentage of gun owners have complied, knowing that registration is the first step to confiscation, these poor souls damn themselves and will accept dictatorship when the time comes.

    Despite having over 2.4 million Firearm Owner Identification (FOID) cardholders in the state, only 112,350 disclosures had been filed by December 31, 2023, according to state police data. An additional 29,357 disclosures were in progress.

    Advocacy groups supporting the Second Amendment have highlighted the confusion among gun owners, attributing the low compliance rate to the vague language of the new law. Dan Eldridge, president of the Federal Firearms Licensees of Illinois lobby group, expressed concerns about the lack of clarity regarding the items covered by the act.

    He mentioned instances where county prosecutors issued notices mandating the registration of assault weapons and high-capacity magazines by January 1. However, Eldridge pointed out that magazines were not required to be registered, as they lack serial numbers, and criticized the governor’s statement that included automatic firearms, which were not mentioned in the act.

    Actual numbers: The latest gun ban registry numbers from Illinois State Police show a total of 29,357 individuals disclosed they are in possession of a banned firearm, accessory and/or ammunition. That’s 1.22% of the state’s 2.4 million Firearm Owners ID cards. 

    Eldridge also noted the influence of “civil disobedience” on the low registration numbers, stating that many sheriffs and county state’s attorneys have declared they will not enforce the act. This lack of enforcement has diminished the incentive for residents in those areas to register their firearms.  Every gun store and every range in the state knows that the vast majority of gun owners prefer to keep the Constitution, rather than listen to the Democrats and their latest gun grab.

    A spokesperson for the Illinois State Police (ISP) claimed that not every FOID cardholder owns a gun, disputing Eldridge’s assertion. Eldridge argued that obtaining a FOID card involves a significant investment of time, expenses, and a thorough background check, suggesting that most cardholders likely own firearms.

    John Boch, executive director of the Illinois Second Amendment advocacy group Guns Save Life, emphasized the widespread non-compliance, with millions of gun owners failing to register their self-defense firearms. Boch attributed the low compliance rate to confusion surrounding the ban, lack of communication from the State Police, and the vague language in both the law and ISP’s rules.

    Ted Riva, president of the Dewitt County Sportsman’s Club, criticized the lack of compliance as a “slap in the face” to the governor and accused politicians of trampling on constitutionally guaranteed rights. Riva highlighted the frustration among law-abiding gun owners, emphasizing that the rush to implement the ban had left many questions unanswered, contributing to the confusion. It is probably better to describe the people’s frustration more akin to a revolutionary spirit. They know, they understand this is all illegal so why play along. Let the governor play tyrant and attempt confiscation.

     

    Erich Pratt, senior vice president of Gun Owners of America, acknowledged that some gun owners might be unaware of the new law, but he emphasized the significant likelihood of blatant civil disobedience. He cited a moral obligation to challenge laws deemed unconstitutional and mentioned that Gun Owners of America is leading one of the lawsuits challenging the ban. In essence, not many legal gun owners will comply with dictatorship and the eventual confiscation of their guns. This is the only reason governments have registrations to begin with.

    In response to the situation, Illinois state police announced that they would not bring charges against state residents who register their property after the deadline. This decision may offer some relief to those who were unable to meet the initial registration deadline amid the widespread confusion and concerns raised by gun owners and advocacy groups.
