The much-anticipated legal action by the family of Ashli Babbitt has been officially filed in Southern California, marking a significant development in the aftermath of her tragic death on January 6th. Seeking $30 million in damages through a wrongful death claim, the family’s lawsuit not only aims to address the loss they suffered but also holds the potential to shed light on the circumstances surrounding Capitol Police Lt. Michael Byrd’s fatal shooting of the unarmed protester.

Ashli Babbitt, a 35-year-old Air Force veteran and ardent Trump supporter, had actively participated in the riot three years ago. While engaging in criminal acts of trespass and property damage, the pivotal question arises: Is it justifiable for an officer to use lethal force against a protester when no weapon is visible before discharging the weapon?

Recapping our previous discussions on the matter, when protesters surged toward the House chamber, Capitol Police barricaded the doors, with officers positioned both in front of and behind Babbitt. As she and others attempted to force their way through, Babbitt was shot by Byrd as she climbed through a broken window.
The Department of Justice’s (DOJ) subsequent review and report, seemingly brushing aside governing standards to clear Byrd, sparked further concerns. Unlike typical post-shooting reviews, the DOJ statement neither unequivocally justified the shooting nor provided clear reasoning for dismissal. Instead, it emphasized the need to prove the officer acted “willfully.”

Contrastingly, legal precedents, such as Graham v. Connor, stress the evaluation of each case’s specific facts and circumstances. Lethal force should only be used against an immediate threat actively resisting arrest. The standards are clear that officers should not shoot unarmed suspects or rioters without a clear threat to themselves or others.
Notably, Officer William “Ben” Darby faced legal consequences for killing a suicidal man despite being cleared by a police review board, highlighting the inconsistent responses to use-of-force incidents.
Byrd, who went public after the Capitol Police’s decision of no further action, contradicted official reviews that had cleared him. He described feeling “trapped” as chants intensified outside the chamber doors, justifying his actions as necessary to protect Congress members and fellow officers. Importantly, he admitted not seeing Babbitt’s hands or any potential threat before firing, yet asserted he had saved countless lives.

The family’s complaint introduces significant new details. It alleges that Babbitt’s hands were visible and empty, and Byrd did not identify himself as a police officer or issue any warnings before the fatal shot.
An intriguing aspect of the complaint is Byrd’s alleged false radio report claiming shots were fired in the lobby after he shot Babbitt. The seven counts in the complaint include assault and battery, negligence, and wrongful death, with the second count on negligence being the most detailed.

Many remain dissatisfied with the government’s initial review, and the discovery process could provide answers to lingering questions surrounding this tragic incident.
