On January 6th, 2021, Ray Epps, a figure repeatedly observed encouraging demonstrators to escalate their actions during the events at the Capitol, has been spared from incarceration for his role in the incident. Instead, Epps has been sentenced to 12 months of probation, a $500 restitution fine, and 100 hours of community service.

Epps’ sentencing memorandum revealed that he should have served six months in jail based on his felonious conduct during the riot. However, the government chose to exercise prosecutorial discretion, offering Epps a pre-indictment misdemeanor plea resolution. Senior trial counsel Michael Gordon from the Department of Justice (DOJ) outlined in the memo that Epps’ case exhibited distinctive and compelling mitigating factors leading to this decision.
Epps’ defense attorney, Edward Ungvarsky, argued against imprisonment, attributing Epps’ predicament to being unfairly targeted by “right-wing political dramaturges,” resulting in attacks on his character. The sentencing memorandum further emphasized the false conspiracy theory that portrayed Epps as an undercover government agent on January 6th.

JAMES RAY EPPS SR. clearly participated in pushing a large metal sign directly into Capitol police officers on January 6, 2021. Others involved were prosecuted and sent to prison.

The document stated that Epps had called the FBI on January 8, 2021, to explain his actions during the Capitol events. Gordon highlighted Epps’ cooperation with both the FBI and the now-defunct House Jan. 6 Select Committee, along with efforts to de-escalate tensions between protesters and law enforcement.

The memo emphasized that Epps, driven by a misguided belief in the alleged election theft of 2020, acted solely on his own accord. Due to the backlash from the false conspiracy theory, Epps claimed to have been forced to sell his business, relocate to a different state, and live in seclusion.
The Epoch Times reported that Epps’ photo was removed from the FBI’s Jan. 6 most-wanted page without explanation, raising questions about the handling of his case.

On September 18, 2023, Epps was charged with one count of disorderly or disruptive conduct in a restricted building or grounds, a petty misdemeanor with a maximum six-month jail term. He pleaded guilty to the charge on September 21, 2023. The swift resolution of the high-profile case contrasted with many January 6 prosecutions that had extended over almost three years.
Sentencing, originally scheduled for December 20, 2023, was later granted a continuance until January 9, 2024, by Chief U.S. District Judge James Boasberg at the federal courthouse in Washington D.C.
In his sentencing memo, Ungvarsky asserted that Epps had intended peaceful protests at the Capitol on January 6th. Acknowledging Epps’ awareness of the mistake made during his participation in the Stop the Steal Rally, Ungvarsky emphasized Epps’ intent for a peaceful protest, both in words on January 5th and actions on January 6th.

Notably, on January 2nd, Ungvarsky filed a motion to shield under court seal the identifying information of persons mentioned in Epps’ sentencing exhibits. Citing safety concerns, the motion redacted names and identifying information due to documented prior harassment and threats against those involved.

An unarmed woman was brutally beaten by 4 capital police officers to within an inch of her life and got hard jail time for 1/6. Ray Epps is on tape instigating a riot.
