    Rep. Stefanik Challenges Gag Order in Trump’s Civil Fraud Case, Sparks Constitutional Concerns

    In a recent turn of events, Representative Elise Stefanik (R-N.Y.) has taken legal action against Justice Arthur Engoron, the judge overseeing former President Donald Trump’s civil fraud case. Stefanik filed a judicial complaint, alleging that the judge’s imposition of a gag order on Trump is “illegal” and constitutes interference in the electoral process.

    Stefanik filed the complaint on Friday after the New York Court of Appeals dismissed a challenge from Trump earlier this week that sought to appeal a gag order imposed on the former president related to the fraud case. Stefanik is challenging the court’s dismissal, accusing Engoron of displaying “biased misconduct” against the former president, according to the complaint first obtained by the Washington Examiner.

    The State of New York Court of Appeals, on Tuesday, rejected President Trump’s appeal against the gag order related to his civil fraud trial. This order, initially instituted by Justice Engoron on October 3, prohibits the former president from making public statements about the judge’s staff. Stefanik, on Friday, challenged the court’s dismissal of Trump’s appeal, emphasizing the broader implications for all New Yorkers.

    In her complaint, Stefanik asserted, “It is unacceptable that any judge in America would place an unconstitutional gag order on a defendant.” She argued that individuals facing a politicized legal process should have the constitutional right to speak out against the judge, court staff, prosecutor, and the entire legal proceedings.

    Stefanik went on to characterize Judge Engoron’s order as “election interference,” condemning the alleged act of illegally silencing a presidential candidate. Expressing concern, she stated that such decisions undermine public faith and confidence in the New York courts, urging an end to what she called a “grotesque miscarriage of justice.”

    This isn’t the first time Representative Stefanik has taken issue with Judge Engoron’s handling of the case. She had previously filed two complaints against the judge on November 10 and 17. The first accused him of “inappropriate bias and judicial intemperance” against President Trump, while the second detailed “illegal political donations and other biased misconduct” by the judge and his staff.

    The civil fraud case against Trump was initiated by New York Attorney General Letitia James. The lawsuit alleges that Trump engaged in persistent fraud through financial statements of the Trump Organization published between 2011 and 2021. The trial, which commenced on October 2, saw President Trump’s public post on Truth Social about Allison Greenfield, the principal clerk of Judge Engoron, leading to the imposition of the gag order.

    President Trump’s post accused Greenfield of being a Democrat loyalist, and Judge Engoron issued the gag order the same day, along with a $10,000 fine. Despite President Trump claiming the post referred to a different individual, the judge deemed it “not credible” and proceeded with the fines. The gag order was eventually extended to Trump’s attorneys as well.

    Stefanik’s recent complaint came just before she joined President Trump at a rally in Concord, New Hampshire. Rumors suggest that Stefanik is under consideration to be President Trump’s running mate in the 2024 elections. As the New Hampshire primary approaches, President Trump enjoys significant support, with a recent poll indicating 52 percent backing among likely Republican primary voters.

    In a Truth Social post on January 21, President Trump urged his supporters to rally behind him in the upcoming New Hampshire primary, signaling his intentions to defeat “Crooked Joe Biden” and “MAKE AMERICA GREAT AGAIN.” The primary, scheduled for January 23, marks the United States’ first primary in this election cycle.  President Trump is expected to win the contest by an absolute landslide, and the latest polling just out shows well over 60-70% of DeSantis’ voters are switching to Trump. This means that if Haley does not bow out of the race before South Carolina, her home state, she is set to be made to look like a total fool losing her home state after New Hampshire, by over 30 points on the low end. This is Trump’s nomination. This is Trump’s party, and soon, this will be Trump’s burden to clean up this massive mess made by the Biden and his crew, shadow run by Obama.
