Texas Attorney General Ken Paxton is set to face trial this spring as the presiding judge, Andrea Beall, rejected his plea to dismiss nearly decade-old felony fraud charges against him. The trial is scheduled to commence on April 15, marking a significant development in the ongoing legal saga. Why do they detest Paxton, like Trump? Well, he is pro-America and against the Deep State. Paxton, currently serving his third term as Texas’ top lawyer, is confronted with two first-degree felony charges of securities fraud, each carrying a potential sentence of five to 99 years in prison. Additionally, he faces a third-degree felony charge of failing to register with state securities regulators. Despite the severity of the accusations, Paxton vehemently denies all charges, attributing them to political motivations.
The legal entanglement traces back to allegations that Paxton sold shares of Servergy, a software company, to two investors in July 2011 without disclosing his receipt of 100,000 shares of company stock in return. Notably, he has been cleared of related civil charges brought by the U.S. Securities and Exchange Commission.

The securities fraud indictments were issued by a Collin County grand jury in August 2015, shortly into Paxton’s initial term as attorney general. However, the case faced numerous delays, involving disputes over prosecutors’ fees, the presiding judge, and the trial’s location. Factors contributing to the prolonged delay included the successful motions to relocate the case from Collin to Harris County, the impact of Hurricane Harvey in 2017, the COVID-19 pandemic, and Paxton’s impeachment trial in the Texas Senate in September, resulting in his acquittal on separate abuse of office allegations.
In an attempt to expedite the proceedings, Paxton filed a motion earlier this month to dismiss the indictments, citing a violation of his constitutional right to a speedy trial. During the recent court hearing in Houston, his defense attorney, Dan Cogdell, attributed the delays to the prosecutors, accusing them of causing an unnecessary “food fight.”
Cogdell argued, “Never in my 42 years of practicing law have I seen a case paused by a fee dispute.” He asserted that the prosecutors, Brian Wice and Kent Schaffer, contributed to the prolonged delay by engaging in a fee dispute with Collin County over promised compensation at a rate of $300 per hour.

The fee dispute, originating from Collin County’s refusal to pay the prosecutors’ second bill of $199,000 after the trial moved to Harris County, has been tangled in the Texas Court of Criminal Appeals. The prosecutors are seeking the court’s intervention to compel Collin County to honor the agreed-upon rate and prevent any actions hindering payment.
In November 2023, Judge Beall ruled in favor of Wice and Schaffer in their payment dispute, characterizing Collin County’s stance as a “transparent and purely political ploy” to obstruct Paxton’s prosecution by defunding it. This ruling, included in a filing with the appeals court, intensified the legal wrangling over finances.
Simultaneously, Paxton’s legal team accused the prosecutors of deliberately prolonging the trial, emphasizing that their client merely seeks his day in court. Expressing frustration, they stated, “Yet, the Special Prosecutors seem content pushing that day further back with its dilatory sideshow of an appeal.”

Following the recent hearing, prosecutor Kent Schaffer announced his withdrawal from the case, with Harris County criminal defense attorney Jed Silverman set to replace him. This unexpected change prompted objections from Paxton’s defense, challenging Wice’s authority to appoint a replacement for Schaffer. Judge Beall agreed to address this issue in a subsequent pretrial hearing on March 20.
