The passing of HB 515 positions Idaho alongside Florida, where a similar law was recently enacted, allowing the death penalty for individuals convicted of sexually abusing children under the age of 12. The bill seeks to amend the current statute, which presently imposes a life sentence for those involved in “lewd conduct with a minor” under the age of 16. HB 515 aims to extend the punishment to include the death penalty for perpetrators engaging in sexual acts with children under 12, particularly in cases involving especially cruel and heinous acts with exceptional depravity.

Idaho State Representative Bruce Skaug, a coauthor of the bills, expressed his disagreement with a 2008 Supreme Court decision that deemed the death penalty for child rape with a surviving victim unconstitutional. Alongside HB 515, the state also approved HB 465, which addresses the emerging threat of AI-generated child pornography. The bill expands existing laws against the creation and distribution of child pornography to encompass AI-generated video imagery and depictions of children. State Representative Dori Healey, a co-sponsor of HB 465, highlighted the global use of technology to create realistic images and videos of children, emphasizing the need for updated legislation to address these evolving challenges.
In response to the growing concern over AI-generated child pornography, dozens of Republican lawmakers, including Representative Bob Good, wrote to the Department of Justice (DOJ) in 2023. The letter expressed serious concerns about the increasing use of AI to generate child sexual abuse materials (CSAM) shared online. While acknowledging the positive uses of AI in various fields, the lawmakers urged the DOJ to take action to prevent the misuse of AI for generating CSAM.

In a letter, prosecutors emphasized the urgency of addressing this issue to protect children from the dangers posed by AI technology. The letter referred to a report by the MIT Technology Review from October 2020, exposing the disturbing use of AI to create hyper-realistic nude images of women, primarily young girls.
