While the charges carried a maximum penalty of five years in prison, a $250,000 fine, and three years of supervised release, the actual sentence delivered by Judge Kelly was lighter than what the prosecutors had sought. The prosecution had recommended a six-month prison term, 36 months of supervised release, and the same $2,000 restitution order.

Charging documents detailed Kuehne’s involvement in the Capitol breach, including charges such as conspiracy, obstruction of an official proceeding, obstruction of law enforcement, and entering and remaining in a restricted building. Prosecutors alleged that Kuehne, along with other Proud Boys from the Kansas City chapter, had planned to attend the rally on January 6, 2021, in Washington.
During the Capitol breach, Kuehne and fellow Proud Boys entered a restricted area, remaining there for over an hour, ignoring law enforcement commands to disperse, as stated by the Department of Justice (DOJ). Subsequently, Kuehne entered the Capitol building, using a portable lectern to block police from closing a door in the Crypt. His actions, according to prosecutors, aimed to impede police and facilitate the group’s movement within the building.

Contrary to the accusations, Kuehne’s wife insisted that her husband did not harm anyone on January 6. She asserted that he came to Washington DC to protect Trump supporters with families from potential Antifa attacks. According to her, while Kuehne did enter the Capitol, he did not cause any damage; in fact, he participated in cleaning trash off the floor and prevented the theft of government property. She expressed bewilderment at what she perceived as the heavy-handed treatment of her husband by federal authorities.
Aside from Kuehne’s case, the same Friday witnessed other law enforcement actions against individuals involved in the Capitol breach. A Florida man faced indictments and arrests on felony and misdemeanor charges, while a Texas man received an 18-month prison sentence and 24 months of supervised release for assaulting a police officer during the incident.

As of now, over 1,313 individuals have been charged in connection with the January 6 incident. Among those convicted, approximately 750 have received sentences, with nearly two-thirds serving time in prison. The most extended prison term, 22 years, was handed down to Enrique Tarrio, the former Proud Boys national chairman, convicted of seditious conspiracy for his alleged involvement in a plot to disrupt the transfer of power on January 6, 2021.
Despite these convictions, dozens of detainees related to the January 6 incident remain in jail, awaiting trial three years after the Capitol breach, reflecting the enduring legal aftermath of that tumultuous day. As President Trump says, these are political hostages. The United States is now a banana republic under Democrat control. November will be all telling as to if we can right this ship legally or not.
