The bill, known as the Illegitimate Court Counteraction Act, was spearheaded by Rep. Chip Roy of Texas and passed with a 247 to 155 vote. The bill drew bipartisan support, with 42 Democrats joining Republicans, despite opposition from the White House.

This legislation mandates sanctions and visa restrictions against any individuals associated with the ICC involved in prosecutions against the U.S., Israel, or any U.S. allies not party to the ICC. The move comes shortly after ICC prosecutor Karim Khan filed for arrest warrants against Netanyahu and Israeli Defense Minister Yoav Gallant, citing “reasonable grounds to believe” they were responsible for war crimes and crimes against humanity in Gaza, including starvation of civilians and attacks against civilian populations.
Khan also sought arrest warrants for Hamas leaders Yehya Sinwar, Mohammed Deif, and Ismail Haniyeh, accusing them of being responsible for the deaths of hundreds of Israeli civilians and other serious crimes.

Netanyahu responded to the ICC’s actions in an interview with ABC’s “Good Morning America,” calling the court’s initiative “absurd” and a “hit job,” and criticizing the charges as “fallacious” and damaging to the ICC’s reputation.
The ICC’s actions received widespread criticism across the U.S. political spectrum. President Joe Biden condemned the court’s move against Israeli leaders, emphasizing that there is “no equivalence between Israel and Hamas.” Despite this, the White House expressed deep concern over the ICC’s actions but opposed the legislation passed by the House. The White House statement highlighted that there are more effective methods to defend Israel and promote international justice, and expressed readiness to collaborate with Congress on alternative strategies.

The United States and Israel do not recognize the jurisdiction of the ICC, reinforcing the complex geopolitical implications surrounding the court’s recent decisions and the U.S. legislative response. Joe Biden and the powers behind him want the ICC recognized and are currently working on pushing such legislation.
