President Joe Biden recently announced an executive order that proposes a major shift in immigration policy, potentially impacting over 500,000 illegal immigrants in the United States. Under this new executive order, illegal immigrant spouses who have lived in the U.S. for at least ten years, are legally married to a U.S. citizen, and obtain approval from the Department of Homeland Security (DHS), could receive deportation protection, work permits, and a pathway to legal status. The individuals affected by this order would have a three-year period to apply for permanent residency, which would allow them to stay and work in the U.S. legally.
However, the legality of Biden’s executive order has been questioned. Critics, including conservative groups and immigration reform advocates, argue that the executive action may be unconstitutional as it might improperly interpret the laws it is based on. They believe that the order usurps congressional authority by expanding the scope of parole-in-place, a legal maneuver intended to be limited and applied on a case-by-case basis, to a broad group of individuals. Biden, who has laughed in the face of the Supreme Court many times now, cares not for what the law is. His desperation is at play, and using every trick in the book to get re-elected is the goal.
