- Judge Amit Mehta, who not only refused to dismiss 1512c2 in J6 cases but also concluded it was a crime of domestic terrorism, has foot-dragged sentencing of Tom Caldwell, a 65-year-old disabled and decorated Navy vet on Jan 6 accused of no violence. Caldwell was convicted of 1512c2 by a DC jury in Nov 2022. Mehta delayed sentencing Caldwell on numerous occasions presumably to see whether SCOTUS would grant cert in 1512c2 matter–which it did on Thursday. Caldwell’s lawyers now asking to hold off his sentencing until SCOTUS issues a decision. DC US Atty Matthew Graves, who wants Caldwell to die in prison, opposes the request. Caldwell has no criminal record and did not enter the building on Jan 6.
