In a surprising turn of events, the Colorado Supreme Court recently issued an order disqualifying former President Donald Trump from its primary ballot in 2024, while he was delivering a speech at a rally in Waterloo, Iowa. This landmark decision, with three out of seven judges dissenting, marks Colorado as the first state in the nation to bar Trump from the upcoming primary.

The Democrat-appointed Colorado high court accused Trump of engaging in “insurrection” during the January 6, 2021, breach of the U.S. Capitol. The controversial ruling sparked immediate reactions, or lack thereof, from the GOP frontrunner.
Notably absent from Trump’s rally remarks was any response to the Colorado decision. However, hours later, he took to Truth Social, posting a series of clips and quotes from experts, lawmakers, and political commentators, concluding with a lamentation, “What a shame for our country!!!” On December 19, both the Trump campaign and the former president’s legal spokesperson announced their intention to appeal the ruling at the U.S. Supreme Court.

If the Supreme Court takes up the case before January 4, President Trump’s name will stay on the Colorado primary ballot. Otherwise, ballots without his name will be finalized on January 5, 2024.
The Trump campaign swiftly denounced the ruling as partisan and claimed that it was part of a political “witch hunt” and “election interference.” Steven Cheung, the campaign spokesperson, labeled it a “left-wing group’s scheme” to curtail “the rights of Colorado voters to vote for the candidate of their choice.” He asserted that the “flawed” decision would be appealed to the U.S. Supreme Court, aiming to put an end to the 14th Amendment challenges.
Alina Habba, legal spokesperson for President Trump, declared that the decision “attacks the very heart of this nation’s democracy” and expressed confidence that the Supreme Court would reverse this “unconstitutional order.” The Trump campaign argues that persistent legal challenges, or “lawfare,” are actually bolstering Trump’s popularity among voters.

In an interview with NTD’s Capitol Report, Habba expressed concerns about the state of the legal system, stating that people are afraid, particularly those from minority communities who fled countries characterized as “banana republics.” She emphasized the importance of voting, regardless of the state’s political leaning.
The Trump campaign’s narrative revolves around the assertion that voters have “lost faith in the failed Biden presidency” and that the administration is doing everything in its power to impede the will of the American voters.
Interestingly, even some political rivals for the 2024 race have criticized the Colorado Supreme Court ruling. Independent candidate Robert F. Kennedy Jr. denounced the decision on social media, emphasizing the need for a fair election and letting voters choose, not the courts.

Vivek Ramaswamy pledged to withdraw from the Colorado primary ballot if the decision wasn’t reversed, urging other candidates like Ron DeSantis, Chris Christie, and Nikki Haley to do the same. DeSantis criticized the court for overreach, emphasizing the importance of letting voters make decisions, while Haley stressed the need for a fair and square competition.
On the other hand, the White House declined to comment on the matter. When asked about President Biden’s stance on Trump being labeled an insurrectionist, White House Press Secretary Karine Jean-Pierre maintained that they wouldn’t get into a legal process and refrained from commenting on Colorado’s decision.
