Days before the vote, former judge Clark Erickson, acting as a hearing officer, heard arguments from both sides. Erickson recommended granting Trump’s motion to dismiss the case but also opined that January 6 constituted an insurrection. He suggested removing Trump on that basis if the motion to dismiss was not granted.
