In a motion filed on February 5, prosecutors argued that the Press Coalition lacked standing, emphasizing that their interest in the case was “ancillary to the main proceedings.” They contended that the Press Coalition’s pursuit of transparency and access to information did not meet the standard for permissive intervention. Prosecutors asserted that the court was already positioned to determine the appropriate level of information disclosure based on submissions from the parties and existing legal precedents.
President Trump had previously advocated for the unsealing of records in a motion filed on January 16, and Mr. Smith’s office had already supported the unsealing with certain restrictions. Prosecutors, in a January 18 motion, backed the unsealing of specific records with redactions, focusing on safeguarding the identity of potential government witnesses mentioned in the defense’s motion.

Prosecutors challenged the Press Coalition’s assertion of standing, arguing that the media’s more than a year of coverage of the legal saga did not establish the necessary elements for intervention. They contended that there was no federal law granting unconditional rights to news media to intervene and emphasized the lack of a non-statutory right in the Press Coalition’s case.
Furthermore, prosecutors argued that President Trump’s motion to unseal the records, filed on February 16, already addressed the Press Coalition’s request to unseal, making it moot. They asserted that the Press Coalition’s objective of encouraging the court to follow the law did not constitute grounds for intervention, as the court was already conducting an independent review.
